These Terms of Use govern your access to and use of the services provided by Onyx Futures LLC, an Illinois limited liability company (ONYX, we, us, or our), including our evaluation programs, simulated trading accounts, and dashboard. By purchasing any ONYX product or creating an account, you agree to be bound by these Terms in full.
1. Nature of the services
ONYX offers simulated futures trading evaluation programs. All trading activity takes place in a simulated environment using paper-trading accounts on the Rithmic platform. ONYX does not manage client funds, route orders to any exchange, or facilitate trading with real capital. Funded accounts, where offered, are simulated and do not represent ownership of actual futures contracts or real financial assets.
2. Eligibility
- You must be at least 18 years of age to use the services.
- You must not be a resident of a jurisdiction where participation in simulated trading programs is prohibited. ONYX does not accept residents of countries subject to comprehensive US OFAC sanctions, including Iran, North Korea, Cuba, Syria, Russia, Belarus, Myanmar, Sudan, South Sudan, and Zimbabwe.
- By registering, you represent that all information you provide is accurate, current, and complete, and that participation is lawful where you live.
3. Pricing and payment
ONYX accounts are sold as a one-time fee. There is no recurring subscription and no monthly billing. Fees are charged in US dollars and processed through PayPal.
Sapphire, Flex, and Gold have no activation fee on new purchases. Legacy Sapphire accounts that were bought with an activation-fee option still pay that fee only when you pass and your funded account is created. Activation fees, where they apply, are non-refundable.
4. Refunds
All fees are non-refundable once trading credentials have been issued. Access to your simulated account and dashboard is granted immediately on payment, so all sales are final. If you have not yet received credentials, contact support within 24 hours of purchase.
5. Chargebacks and disputes
Initiating a chargeback or payment dispute for a legitimate ONYX charge is a material breach of these Terms. You agree to contact support before opening any dispute. A chargeback opened without first contacting support results in immediate and permanent termination of your account and all associated accounts, and ONYX may pursue recovery of the disputed amount and report the incident to fraud-prevention services.
6. Evaluation rules and conduct
To pass an ONYX evaluation and qualify for a simulated funded account, you must follow all account rules. The full, current rule set is published at onyx-futures.com/rules. In summary:
- Reach the profit target for your account size over a minimum of three trading days on Sapphire or Gold. Flex has no minimum trading days — pass once you clear the target and the 52% evaluation consistency rule.
- Never breach the end-of-day trailing drawdown. Drawdown is calculated at market close, not intraday.
- Observe the 40% consistency rule on Sapphire, Ruby, Gold and Platinum, and the 52% consistency rule during the Flex evaluation only. No ONYX account carries a forced daily loss limit; you may optionally set your own from the dashboard.
- Trade only futures listed on CME, COMEX, NYMEX, and CBOT. Stocks, options, forex, crypto, and CFDs are prohibited.
- Close all positions at least two minutes before scheduled tier-1 economic releases.
- There is no minimum hold time. Microscalping is allowed. Automated trading is not, and overnight or weekend holds are not permitted.
- There is no limit on how many evaluation accounts you may hold at once. Funded accounts are limited to 5 tradable at a time. If you pass another evaluation while holding 5 funded accounts, that funded account is still yours: it is placed on standby and activates automatically, oldest first, as soon as one of your funded accounts closes. Express to Live is separate and is limited to 6 active accounts and $6,000 in combined drawdown. Latency arbitrage, account sharing, and exploitation of system errors are prohibited and result in disqualification.
7. Funded accounts
On passing, you receive a simulated funded account: Ruby on the Sapphire track, Flex Funded on the Flex track, or Platinum on the Gold track. You keep up to 100% of your profits, set by the size of each payout request.
Payout requests are approved in under 24 hours. If approval is ever late, $300 is added to your payout. The 40% consistency rule applies at payout on Ruby and Platinum, and before your first payout on those tracks your balance must reach the published first-payout buffer for your size. Flex Funded has no first-payout buffer and no consistency rule at payout; you may withdraw up to 50% of your total profit above your starting balance, and you need five winning trading days since your last payout (each day with realized profit of at least 10% of your drawdown — $100 on the 25K, $200 on the 50K, $300 on the 100K, $450 on the 150K). Ruby and Flex Funded share the same per-request payout caps. Diamond is our live program. ONYX may move you to it at any time under section 15, which closes your simulated funded accounts. ONYX may decline a payout request, reset a funded account under section 8, reduce account size, suspend, or terminate a funded account for rule violations. Funded accounts are simulated.
8. Risk management and payout decisions
No ONYX account carries a forced daily loss limit, so the amount you put at risk on any trade is yours to choose. ONYX publishes risk management standards at onyx-futures.com/rules that set the point at which that choice becomes a matter for review. They limit how much of an account's drawdown a single trade or a single protective stop may put at risk, and they compare the risk taken on a funded account with the risk taken on the evaluation that earned it.
Each standard is measured across every account you hold rather than one account at a time, and each is measured as a rate over a stated minimum number of trades rather than as a single incident. One oversized trade is not a breach. The same sizing repeated across your trades, or repeated across several accounts you hold at once, can be. Holding more accounts does not divide these standards between them.
These standards take effect on July 21, 2026 and apply to any trade on your account, including trades made before that date.
If ONYX finds that you have breached a risk management standard or any other trading rule on a funded account, ONYX may decline the payout request affected by the breach, reset the funded account, or both. A funded account reset returns the account balance to its starting balance, whether that is higher or lower than the balance at the time of the reset, clears the account's trading journal, and clears the account's progress toward its payout requirements, including its winning day count, its consistency measurement since the last payout, and its first payout buffer where the account has one. It is not a return to the evaluation phase and no new fee is charged: you keep the funded account, its type, its size, its drawdown, its profit split and its contract limit. The trading journal is archived first and can be restored. The balance change is made at the broker and cannot be undone.
No decision under this section is automatic. ONYX systems produce evidence and a member of the ONYX team makes every decision. ONYX applies these standards using the order records and fill records produced by your trading platform and periodic snapshots of your account balance and open position, on Rithmic accounts only. A protective stop that did not rest at the exchange does not appear in those records and cannot be produced as evidence in your favor. Trading without a resting protective stop, and cancelling a protective stop while a position is still open, are not breaches of these standards, and ONYX does not decline a payout for either of them on its own. Where ONYX holds no records for a period, that absence means the activity is unknown and not that a breach occurred.
ONYX notifies you in writing when a payout is declined or a funded account is reset, and states the standard or rule breached, the trading activity relied on and the dates of that activity. You may appeal by replying to that notice or by emailing support@onyx-futures.com within 3 days of its date. Your appeal is reviewed by a person other than the one who made the original decision, and ONYX does not reset an account while an appeal against that decision is open.
9. Account resets
If you breach the drawdown or other evaluation rules, your account is failed. You may purchase a reset to restart at the same account size with your metrics cleared. Sapphire resets run $65 to $170 by size, and Flex resets scale by account size from $69 to $249. You can reset five accounts for the price of four. Resets are a one-time payment and are non-refundable. A reset you purchase is not the same as the funded account reset described in section 8.
10. Termination
ONYX may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, abusive behavior toward staff, chargebacks, or any conduct deemed detrimental to ONYX or its community. No refunds are issued on termination.
11. Intellectual property
All content, software, trademarks, and materials on the ONYX platform are the property of Onyx Futures LLC. You may not copy, reproduce, or redistribute any ONYX content without prior written consent.
12. Limitation of liability
To the maximum extent permitted by law, ONYX is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the services. ONYX's total liability for any claim shall not exceed the amount you paid to ONYX in the 30 days preceding the claim.
13. Governing law
These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-law rules. Disputes are resolved through binding arbitration on an individual basis, and you waive any right to participate in a class action or class-wide arbitration against ONYX.
14. Amendments and contact
ONYX may update these Terms at any time. Continued use of the services after a change constitutes acceptance of the revised Terms. We notify users of material changes by email or dashboard notice. Questions about these Terms can be sent to support@onyx-futures.com.
15. The live program
ONYX operates a live funding program, known as Diamond. Placement in it is at ONYX's sole discretion. ONYX may move you to the live program at any time, with or without a request from you, and whether or not you have met any published or unpublished objective. There is no right to be moved, and being eligible does not mean you will be.
When ONYX moves you to the live program, every simulated funded account you hold is closed at that point. Closure is complete and permanent: the account stops trading, its balance ceases to be available for withdrawal as a simulated payout, and it is not reopened if you later leave the live program. Simulated evaluations you hold that have not yet passed are not closed by this and continue under their own rules.
A simulated balance is not cash and is not owed to you. Where ONYX moves you to the live program it sets the live funding it will provide, and it tells you that figure in writing when it moves you. That figure is set by ONYX and is not a payment of any simulated balance.
Live funding is released in phases. The full amount stated to you is not available at the start, and each further phase is released at ONYX's discretion. ONYX tells you in writing what is released at the point you are moved.
Before any live trading begins you must complete and return the documentation ONYX requires, which includes a power of attorney. Until that documentation is received and accepted, no live account is opened and no live funding is released. If you do not return it, or ONYX does not accept it, you remain without a live account and your simulated funded accounts stay closed.
Being moved to the live program ends your eligibility to purchase further simulated accounts. ONYX may also disable purchasing for any account holder at any time, whether or not they are being moved to the live program.
ONYX notifies you in writing when it moves you, and states the live funding figure, what is released at that point, which simulated accounts have been closed, and what documentation is required. The live program is governed by the documentation you sign for it, and where that documentation conflicts with these Terms, that documentation governs your live account.
