Every ONYX evaluation takes place in a simulated environment using virtual funds. No real capital is at risk in an evaluation and no live market execution occurs in it. Results in simulation are not indicative of results that would be achieved in live trading with real capital.

A live account opened after a passed evaluation is not simulated. It is a real brokerage account at a futures commission merchant, held in ONYX's name and funded with ONYX's own capital, and the trading in it is real.

ONYX makes no guarantee that you will pass an evaluation, be made eligible for a live account, or earn any profit. Most traders do not pass an evaluation. Past performance, whether actual or simulated, is not indicative of future results.

Hypothetical or simulated performance results have certain inherent limitations. Unlike an actual performance record, simulated results do not represent actual trading. Because the trades have not been executed, results may have under or over compensated for the impact of factors such as lack of liquidity. Simulated trading programs are also designed with the benefit of hindsight. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown or discussed.

Trading futures involves substantial risk of loss and is not suitable for every investor. Futures prices can be highly volatile. Futures are leveraged, so a small price movement can produce a large gain or loss relative to the margin involved. Only risk capital, money you can afford to lose without affecting your financial security or lifestyle, should be used for trading.

Participation in an ONYX evaluation does not guarantee eligibility for a live account, and eligibility does not guarantee that one is opened: the documentation ONYX requires, including a limited power of attorney, must be returned and accepted first. Evaluation fees are non-refundable regardless of outcome.

Passing an evaluation makes you eligible for a live account. No live account is opened until the documentation ONYX requires, including a limited power of attorney, has been returned and accepted, and placement is subject to the acceptance of the futures commission merchant.

A live account involves real money and real market risk. Losses in it are real losses. The account is held in ONYX's name and funded with ONYX's own capital; you are not the account holder and your entitlement is a contractual share of net profits only.

Results produced in a simulated ONYX evaluation, including any balance, payout or certificate, are not indicative of live results and are not a promise of live performance. Being eligible for a live account is not a guarantee of profit, of continued funding, or of any particular amount of funding.

Electronic trading carries risks including hardware failures, software defects, connectivity issues, and data-feed interruptions, which may affect your ability to enter, modify, or cancel orders. ONYX does not guarantee uninterrupted access to the platform and is not liable for losses or missed opportunities resulting from downtime.
