You understand that generally we do not pre-screen or monitor the content posted by users of these various communication tools, which means that if you choose to use these tools to submit any type of content to our website, then it is your personal responsibility to use these tools in a responsible and ethical manner.

3. Customer Due Diligence (CDD) & Anti-Money Laundering (AML) Policies

Our Customer Due Diligence and Anti-Money Laundering policies are designed to ensure the responsible use of our platform and compliance with applicable regulations. As a user, you agree to provide accurate and up-to-date information during registration and throughout your use of our services.

We implement ongoing monitoring of account activity, with automated systems and predefined thresholds for suspicious activities triggering further investigation. Enhanced Due Diligence is conducted for high-risk customers as determined by our internal risk assessment framework.

You agree to cooperate with our CDD/AML procedures and acknowledge that we may suspend or terminate accounts that trigger our suspicious activity monitoring protocols. We retain customer information and transaction records in accordance with our record-keeping policies and applicable laws.

In conjunction with the Limitation of Warranties as explained above, you expressly understand and agree that any claim against us shall be limited to the amount you paid, if any, for use of products and/or services. Onyx Futures LLC will not be liable for any direct, indirect, incidental, consequential or exemplary loss or damages which may be incurred by you as a result of using our Resources, or as a result of any changes, data loss or corruption, cancellation, loss of access, or downtime to the full extent that applicable limitation of liability laws apply.

7. Copyrights / Trademarks

All content and materials available on Onyx Futures, including but not limited to text, graphics, website name, code, images and logos are the intellectual property of Onyx Futures LLC, and are protected by applicable copyright and trademark law. Any inappropriate use, including but not limited to the reproduction, distribution, display or transmission of any content on this site is strictly prohibited, unless specifically authorized by Onyx Futures LLC.

8. Termination of Use

You agree that we may, at our sole discretion, suspend or terminate your access to all or part of our website and Resources with or without notice and for any reason, including, without limitation, breach of this User Agreement. Any suspected illegal, fraudulent or abusive activity may be grounds for terminating your relationship and may be referred to appropriate law enforcement authorities. Upon suspension or termination, your right to use the Resources we provide will immediately cease, and we reserve the right to remove or delete any information that you may have on file with us, including any account or login information.

9. Responsible Trading Policy

Traders may have a maximum of 5 active funded accounts simultaneously. Each customer is permitted to register only one email address. This measure ensures compliance with our maximum allocation policy and facilitates seamless communication between our platform and our valued customers.

10. Governing Law & Venue

This website is controlled by Onyx Futures LLC from our offices located in the state of Illinois. By accessing our website, you agree that the statutes and laws of Illinois, without regard to its conflict of laws principles, will apply to all matters relating to the use of this website and the purchase of any products or services through this site.

Any action to enforce this User Agreement shall be brought exclusively in the state courts located in Cook County, Illinois, or the United States District Court for the Northern District of Illinois. You hereby agree to personal jurisdiction by such courts, and waive any jurisdictional, venue, or inconvenient forum objections to such courts.

11. Class Action Waiver & Arbitration Agreement

By agreeing to these Terms of Service, you hereby waive any right to participate in or bring a class action lawsuit against Onyx Futures LLC. This waiver does not apply to claims that cannot be waived as a matter of Illinois law, including certain consumer protection claims. All disputes must be resolved on an individual basis, and any relief awarded cannot affect other users.

You have the right to opt out of this arbitration agreement within 30 days of accepting these Terms by sending written notice to 1939 S Jonathan Dr. If you do not opt out, you agree to arbitrate any disputes on an individual basis before a neutral arbitrator in Cook County, Illinois.

12. Dispute Resolution

By purchasing Onyx Futures’ products, the user explicitly waives all rights to dispute any payments related to the products. This waiver is comprehensive and binding, and any disputes raised by the user concerning these payments will not be entertained. In the event of a dispute, the user agrees that the bank or financial institution involved shall acknowledge the terms of this agreement and return any disputed funds to Onyx Futures LLC without delay.

13. Refund Policy

If you purchase an evaluation account with us and change your mind, we will refund you within 72 hours of purchase. This DOES NOT include accounts that have been used and/or traded. These refunds will be the amount you paid minus technology and market data fees we have incurred on your behalf.

14. Trading Program Disclaimer

The evaluation program is a challenging assessment designed to simulate real market conditions. It is important to note that successfully passing the evaluation requires a high level of skill and experience in trading. Our evaluation is challenging, and even seasoned traders often find it demanding. As such, we recommend our evaluation primarily for those with substantial trading experience.
